Terms of Service

Effective date: October 30, 2026Questions? contact@overlandtowservice.com

These Terms of Service ("Terms") are an agreement between you and Overland Tow Service, Inc. ("Overland Tow," "we," "us"), 3505 Merriam Dr, Suite B, Overland Park, Kansas 66203. They apply when you use overlandtowservice.com, our online booking pages (including those hosted at towmaticai.com), the Overland Tow mobile app, or our phone, text, or messaging services, and when you request or receive our services. By doing any of these, you agree to these Terms and to our Privacy Policy.

1. Our services

Overland Tow provides towing, flatbed towing, emergency towing, roadside assistance (jump starts, lockouts, tire changes, and winch-outs), local and long-distance towing, motor club service, private property towing, vehicle relocation for special projects, and vehicle storage. We do not deliver fuel.

We serve the Kansas City metro area and other areas we agree to. Private property towing is offered in Kansas only. We may decline or reschedule any request because of vehicle type, location, weather, road or safety conditions, or driver availability.

2. Online requests, quotes, and scheduling

  • A request is not a guarantee. A form, call, text, or message is a request for service. Service is confirmed when we dispatch a driver or send you a confirmation.
  • Arrival times are estimates. Traffic, weather, and call volume can affect them.
  • Quotes depend on what you tell us. Prices are based on the vehicle, locations, and conditions you describe. The final price may change if that information is wrong or incomplete, or if the job needs more time, equipment, mileage, or labor than expected.
  • Scheduled tows depend on availability. We will contact you if we cannot meet a requested time.
  • Accurate information. You agree that the information you give us is true and complete, and that you own the vehicle or are authorized to request service for it.
  • Location. If you use "Use My Current Location," please confirm the address is correct. GPS results can be inaccurate.

3. Prices and payment

Payment is due when service is completed unless we have agreed in writing to bill you or your business. You authorize us to charge the payment method you provide for the services performed. Business accounts must pay according to the terms on their invoice. Fees for police-requested and private property tows, and for storage, follow the limits set by applicable law.

4. Cancellations and no-shows

If you cancel after a driver has been dispatched, or the driver arrives and the vehicle, keys, or an authorized person is not there as described, we may charge a cancellation or trip fee. We will tell you the amount when you request service or when you cancel.

5. Your vehicle and belongings

  • Remove valuables and personal items before service. We are not responsible for items left in a vehicle, except where loss is caused by our negligence.
  • Pre-existing damage. We are not responsible for damage that existed before service. We may photograph the vehicle's condition.
  • Vehicle conditions. Some vehicles carry extra risk during towing or roadside service, such as lowered or modified vehicles, all-wheel-drive vehicles that cannot go into neutral, locked brakes, or vehicles in parking garages. Tell us about these conditions so we can send the right equipment.
  • Report damage promptly. Inspect your vehicle at delivery and report any damage you believe we caused at that time, or within 24 hours, by calling 913-722-3505.
  • Roadside service limits. Some problems cannot be fixed on site, such as a battery that will not hold a charge or a tire that cannot be safely changed. If so, we may recommend a tow.

6. Private property towing

If you request a tow from private property, you confirm that you are the property owner, manager, or an agent authorized in writing to request tows for that property. You are responsible for posting and maintaining any signs the law requires. Tenants and residents may request tows from their own assigned spaces only if the property has authorized it with Overland Tow in advance.

Overland Tow performs private property tows in line with Kansas law and local ordinances. You agree to cover Overland Tow's costs and liability resulting from a tow you requested without proper authority or based on false information.

7. Storage and vehicle release

Vehicles stored at our lot accrue daily storage fees until released. To release a vehicle, the owner or authorized agent must show valid photo ID, proof of ownership or authorization, and pay all charges owed. Releases happen during posted lot hours. Vehicles left unclaimed may be handled under Kansas abandoned vehicle and lien laws.

8. Text messages

By giving us your mobile number or texting us, you agree to receive texts about your request, including confirmations, quotes, driver updates, and arrival times. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. Carriers are not liable for delayed or undelivered messages. See our Privacy Policy for how we handle your number.

9. AI assistants and messaging

Some calls, texts, and messages, including messages through Google Search and Google Maps, may be answered by an AI assistant. AI answers are for general information and may contain errors. Prices, arrival times, and service details are final only when confirmed by our dispatch team. Calls and messages may be recorded and kept as described in our Privacy Policy.

10. Using our websites, app, and forms

You agree not to submit false, prank, or fraudulent requests, send spam, interfere with our systems, or use our services for anything unlawful. We may refuse service, block access, and report false requests to the authorities. Our websites and app may be unavailable at times for maintenance or outages. Call 913-722-3505 if you cannot submit a request online.

The content, logos, and design of our websites and app belong to Overland Tow or its licensors and may not be copied without permission.

11. Third-party services

Our services rely on third parties such as Google, app stores, phone carriers, and payment processors. Their own terms apply to your use of their services, and we are not responsible for their actions or outages.

12. Disclaimers

We perform services with reasonable care. Our websites, app, forms, and AI assistants are provided "as is" and "as available," without warranties of any kind, to the fullest extent the law allows.

13. Limitation of liability

To the fullest extent the law allows, Overland Tow is not liable for indirect, incidental, or consequential damages, including lost wages, lost profits, rental car costs, or missed appointments. Overland Tow's total liability for any claim related to a service is limited to the amount you paid for that service, except for vehicle damage caused by our negligence or where the law does not allow this limit. Nothing in these Terms limits liability for gross negligence or willful misconduct.

14. Indemnification

You agree to cover Overland Tow's losses, costs, and reasonable attorney's fees arising from false information you give us, a service you request without authority, or your violation of these Terms.

15. Governing law and disputes

These Terms are governed by the laws of the State of Kansas. Any dispute will be resolved in the state or federal courts located in Johnson County, Kansas, and you agree to their jurisdiction. Either party may bring a claim in small claims court if it qualifies. Please contact us first; most issues can be resolved quickly.

16. Other terms

We may update these Terms. The effective date at the top shows when they last changed, and continued use means you accept the updated Terms. If any part of these Terms is found unenforceable, the rest stays in effect. These Terms and our Privacy Policy are the entire agreement between you and Overland Tow about their subject, except for any written agreement or invoice terms for a specific job.
